The Sarpy County Planning Commission held its regular monthly meeting Wednesday, July 21, 1999 in the County Board Room at the Sarpy County Courthouse, Papillion, Nebraska. Chair Meyer called the meeting to order at 7:30 p.m. with the following members present: Charles Buller, Charles Denny, Bill Leonard, John Johnson, Joe Mangiamelli, Marcia Matthies, Dennis Nichols, Wendy Gottsch, and Alan Wear. Absent was Thomas Wees. Ken Tex, Sarpy County Chief Building Inspector/Planning Coordinator, Cindy Gilbert, Recording Secretary and Tamra Walz, Deputy County Attorney were also present.

Chair Meyer asked for any reports from commissioners. There were none.

Chair Meyer asked for a motion to approve the agenda as submitted. Matthies moved, seconded by Leonard, to approve the agenda as submitted. Ballot: Ayes - Buller, Denny, Leonard, Johnson, Matthies, Mangiamelli, Nichols, Gottsch, and Wear. Nays - none. Absent - Wees. Motion carried.

Chair Meyer asked for additions or corrections to the minutes of the previous meeting. Matthies moved, seconded by Leonard, to approve the minutes as submitted. Ballot: Ayes - Buller, Denny, Leonard, Johnson, Mangiamelli, Matthies, Nichols, Gottsch and Wear. Nays - none. Absent - Wees. Motion carried.

Notice of this meeting and the applications to be heard was published in the Bellevue Leader and the Gretna Guide. Notice of the meeting and the agenda were sent to all members of the Sarpy County Planning Commission and the applicants.

Consent Agenda:

No applications were listed on the consent agenda.

Regular Agenda:

1. Shane Cerone, David Dickinson, Amy Littlejohn, Matthew Cerone, Anthony Cerone and Julie Dickinson Fjell of 5905 S. 222nd Street, Elkhorn, NE 68022 requests approval of a final plat on a subdivision to be known as Albro Acres on the following described property, to wit: Part of Sec 14, Twp 14N, Rng 10E of the 6th P.M., Sarpy County, Nebraska (225th Street, 2 mile south of Harrison)

Nancy Cerone, representing the family, asked for the final plat to be approved.

Chair Meyer read into record that Tom Lynam, County Surveyor, indicated the number of driveways could be at four (4) because of the waterways.

Johnson moved, seconded by Leonard, to recommend approval of the final plat as it conform with the preliminary plat. Ballot: Ayes - Buller, Denny, Leonard, Johnson, Matthies, Mangiamelli, Nichols, Gottsch and Wear Nays - none. Absent - Wees. Motion carried.

2. Vann Realty Company of 4601 S 50th Street, Omaha, NE 68117 requests approval of a change of zone from BG to RG-10 on the following described property, to wit: Lot 3B, being a part of Lot 3, Willow Creek Replat III, a subdivision located in the N1/2 of the NE1/4 of Sec 14, Twp 14N, Rng 11E of the 6th P.M., Sarpy County, Nebraska, (SW corner of 144th & Harrison)

Larry Jobeun, attorney for Vann Realty, presented facts pertaining to the proposed apartments in trying to obtain a change of zone. He included that fact that they are proposing a 54 unit apartment with 24 garages. He answered the question by Don Meyer about the location of the entrance with respect to the entrance to Kwik Shop by saying that with the median strip being placed on Harrison, the existing entrance to Kwik Shop would be unaccessible for westbound traffic and that an access road for both the apartments and Kwik Shop would be placed west of the present Kwik Shop entrance.

Don Meyer then read into record the comment from Tom Lynam, County Surveyor and letters from Gene Gollehon, Deputy County Surveyor, and Mark Wayne, County Administrator.

Dennis Nichols questioned Mr. Jobeun about how he would handle the fire department requests and if he had already talked to them. Mr. Jobeun refered to Tom Vann who said they would do whatever the fire department required of them as well as anything the county surveyors office would require of them.

Wendy Gottsch inquired about the road improvements on Harrison in that area.

Jobeun responded by saying that it would be sometime in the year 2000 or 2001 before improvements were completed on Harrison. He then asked that the board approve the change of zone based on the information he had given.

Chair Meyer entertained a motion for the change of zone. Nichols moved, seconded by Matthies, to recommend approval of the change of zone as it is consistent with the comprehensive development plan. Ballot: Ayes - Buller, Denny, Leonard, Matthies, Mangiamelli, Nichols, Gottsch and Wear. Nays - Johnson. Absent - Wees. Motion carried.

3. Paul & Jennifer Edwards of 15950 S 75th Street, Papillion, NE 68046 requests approval of a change of zone from AG to REII on Lots 1-2 and from AG to AGR on Lots 3-4 and a preliminary plat on a subdivision to be known as Edwards Estates on the following described property, to wit: A platting of the south 2 of the NW1/4 of the SE1/4 of Sec 23, Twp 13N, Rng 12E of the 6th P.M., Sarpy County, Nebraska. (Approximately 1 1/4 miles south of Platteview Road & 75th Street)

Paul Edwards told the board he wanted to split his land into four lots and needed a change of zone to do that.

Marcia Matthies questioned the preliminary plat=s location of the road easement because she had visited the property and noticed the road being constructed on the south side of the property as opposed to the center where the plat shows the road.

Discussion ensued between the commission members and Mr. Edwards about the location of the road easement. Mr. Edwards conceded that the road will come along the south end the lot 2 and cut north part way into lot 3 so that lot 4 will be accessible.

After more discussion, Matthies moved, seconded by Gottsch, to recommend approval of the change of zone as it complies with the comprehensive development plan. Ballot: Ayes - Leonard, Matthies, Mangiamelli, Nichols, Gottsch and Wear. Nays - Buller, Denny and Johnson. Absent - Wees. Motion carried.

Matthies moved, seconded by Gottsch, to recommend approval of the preliminary plat with the amended change to the road easement (including cul-de-sac) drawn by the surveyor on the plat that is presented to the board. Ballot: Ayes - Leonard, Matthies, Mangiamelli, Nichols, Gottsch and Wear. Nays - Buller, Denny and Johnson. Absent - Wees. Motion carried.

4. Barkley Farms, Inc. (Charles & Sharon Barkley) of 18484 Cornhusker Road, Omaha, NE 68136 requests approval of a change of zone from AG to RS-100 and a preliminary/final plat on a subdivision to be known as Barkley Acre on the following described property, to wit: Part of the N1/2 of the NE1/4 of Sec 29, Twp 14N, Rng 11E of the 6th P.M., Sarpy County, Nebraska. (185th & Cornhusker Road)

Charles Barkley of Barkley Farms, Inc., addressed the board indicating their desire to sell the old farm house and .92 acres of ground, keeping the rest of the farm.

Chair Meyer entertained a motion for a change of zone. Nichols moved, seconded by Matthies, to recommend approval of a change of zone from AG to RS-100 as it complies with the comprehensive development plan. Ballot: Ayes - Buller, Denny, Leonard, Johnson, Mangiamelli, Nichols, Gottsch and Wear. Nays - none. Absent - Wees. Motion carried.

Nichols moved, seconded by Matthies to recommend approval of the preliminary/final plat because it conforms to the comprehensive development plan and zoning regulations. Ballot: Ayes - Buller, Denny, Leonard, Johnson, Matthies, Mangiamelli, Nichols, Gottsch and Wear. Nays - none. Absent - Wees. Motion carried.

5. Robert Anderson of 2121 S 73rd Street, Omaha, NE 68124 requests approval of a change of zone from BGH to BHS and a preliminary/final plat of a subdivision to be known as Prairie Corners Replat IV on the following described property, to wit: Tax Lot 1A1B located in part of the NE1/4 of Sec 26, Twp 14N, Rng 11E of the 6th P.M., Sarpy County, Nebraska. (Highway 50 & Frontier Road)

Bob McKee of Lamp, Rynearson & Associates, representing Robert Anderson, explained to the board why Mr. Anderson would like to have a change of zone indicating that the new zoning would be more compatible with the business in the area and they intended to make three lots out of the one with the intention of selling the other two lots for other businesses. The third lot already houses Anderson=s Amoco.

Johnson moved, seconded by Leonard to recommend approval of a change of zone from BGH to BHS as it complies with the comprehensive development plan. Ballot: Ayes - Buller, Denny, Leonard, Johnson, Matthies, Mangiamelli, Nichols, Gottsch and Wear. Nays - none. Absent - Wees. Motion carried.

Johnson then moved, seconded by Leonard to recommend approval of a preliminary/final plat as it complies with the comprehensive development plan. Ballot: Ayes - Buller, Denny, Leonard, Johnson, Matthies, Mangiamelli, Nichols, Gottsch and Wear. Nays - none. Absent - Wees. Motion carried.

6. Michael & Susan Patak of 8787 S 204th Street, Gretna, NE 68028 requests approval of a change of zone from AG to AGR (Lot 1) and AG to AGD (Lot 2) and a preliminary/final plat of a subdivision to be known as Sarpy Heights III Replat 1 on the following described property, to wit: Being a replatting of Lot 2, Sarpy Heights III, a subdivision as surveyed, platted and recorded in Sarpy County, Nebraska. (Hwy 6 & Lindale Drive)

Michael Patak approached the board with his plans to divide his property with one 5 acre lot and one 16+ acre lot saying that he wanted to sell the existing home with the 5 acres and to possibly build a new one on the rest.

Chair Meyer read into record a memo from Tom Lynam, County Surveyor followed by Cindy Gilbert, recording secretary reading into record a letter from the Papio-Missouri Natural Resources District.

Terry Stueckrath, along with Lori Stueckrath, voiced their concerns about property values and losing their view if another house is put on a lot so close to theirs.

Jean Kardell also voiced concerns about property values.

Rodney Oberle asked the board if they would consider giving S.I.D. 34 a chance to meet and come back to another meeting with their recommendations.

Eric Hupka also addressed his concerns to the board.

Discussion ensued between the commission members concerning the Patak property.

Chair Meyer entertained a motion to close the public hearing. Johnson moved, seconded by Nichols, to close the public hearing at 9:10 p.m. and to table this application by Michael Patak until the August 18, 1999 meeting so that S.I.D. 34 could meet and bring in their recommendations to the planning commission. Ballot: Ayes - Buller, Denny, Leonard, Johnson, Matthies, Mangiamelli, Nichols and Wear. Nays - Gottsch. Absent - Wees. Motion carried.

Correspondence:

* It was suggested that the future land use map be reviewed in Sec 19, Twp 14N, Rng 10E for possible amendment to remove it from commercial use.

* Tamra Walz addressed the commissioners regarding county zoning rights for school lands.

There being no further business, Matthies moved, seconded by Gottsch to adjourn the meeting at 9:20 p.m. With a unanimous vote, the motion carried.
