The Sarpy County Planning Commission held its regular monthly meeting
Wednesday, October 20, 1999 in the County Board Room at the Sarpy County Courthouse,
Papillion, Nebraska. Chair Meyer called the meeting to order at 7:30 p.m. with the
following members present: Charles Buller, Charles Denny, Bill Leonard, John Johnson,
Marcia Matthies, Wendy Gottsch, Thomas Wees and Alan Wear. Absent were Dennis Nichols and
Joe Mangiamelli. Ken Tex, Sarpy County Planning and Zoning Coordinator and Cindy Gilbert,
Recording Secretary were also present.
Chair Meyer asked for any reports from commissioners. There were none.
Chair Meyer asked for a motion to approve the agenda as submitted.
Cindy Gilbert noted that Agenda Items # 3 and #4 were to be removed because they have been
inadvertently sent to the wrong Planning Commission. Wees moved, seconded by Gottsch, to
approve the agenda as corrected. Ballot: Ayes - Buller, Denny, Leonard, Johnson, Matthies,
Gottsch, Wees and Wear. Nays - none. Absent - Mangiamelli and Nichols. Motion carried.
Chair Meyer asked for additions or corrections to the minutes of the
previous meeting. Matthies moved, seconded by Johnson, to approve the minutes as
submitted. Ballot: Ayes - Buller, Denny, Leonard, Matthies, Gottsch, and Wees. Abstain -
Wear. Nays - none. Absent - Mangiamelli and Nichols. Motion carried.
Notice of this meeting and the applications to be heard was published
in the Bellevue Leader. Notice of the meeting and the agenda were sent to all members of
the Sarpy County Planning Commission.
Consent Agenda:
No applications were listed on the consent agenda.
Regular Agenda:
1. Timothy P. Dickey of 7508 S 46th Avenue, Bellevue,
Nebraska requests approval of a Special Use Trailer Permit on the following described
property, to wit: Site 13, Riha Land located in Sec 32, Twp 13N, Rng 12E of the 6th
P.M., Sarpy County, Nebraska. (110th & Buffalo)
Timothy Dickey spoke to the
commission about this permit being for an existing trailer. He is the new owner and would
like the permit as required.
Johnson moved, seconded by Denny, to recommend approval of the
special use trailer permit for three years with renewal by publication because it complies
with special use regulations. Ballot: Ayes - Buller, Denny, Leonard, Johnson, Matthies,
Gottsch, Wees and Wear. Nays - none. Absent - Mangiamelli and Nichols. Motion carried.
2 Mike Healy, agent for The Everest Group of 8941 Miami Street, Omaha,
Nebraska requests approval of a Special Use Permit to erect a wireless antenna facility
with a 110' monopole tower on the following described property, to wit: Part of Tax Lot 1A
located in the N1/2 of the NE1/4 of Sec 22, Twp 14N, Rng 11E of the 6th P.M.,
Sarpy County, Nebraska. (SW corner, Giles & 156th St.)
Mike Healy introduced himself as the agent for The Everest Group,
representing Sprint PCS and explained how and why they chose this location for their tower
saying that since OPPD already had poles for their power lines, his company felt this
would be an appropriate place to erect a tower.
Johnson moved, seconded by Wees recommended approval for the special
use permit because it meets special use regulations and complies with the Comprehensive
Development Plan. Ballot: Ayes - Buller, Denny, Leonard, Johnson, Matthies, Gottsch, Wees
and Wear. Nays - none. Absent - Mangiamelli and Nichols. Motion carried.
3. Bob McKee, agent for Edwin and Jacquelyn Mowinkle of 9901 South 176th
Street, Omaha, Nebraska requests approval of a change of zone from AG to IL and from BG to
IL on the following described property, to wit: Tax Lot 5 located in the NE1/4 of Sec 34,
Twp 14N, Rng 11E of the 6th P.M. Sarpy County, Nebraska. (SW quadrant of I-80
& Hwy 370)
Bob McKee of Lamp, Rynearson and Associates, representing Edwin and
Jacquelyn Mowinkle, addressed the commissioners as to the purpose of their request to
change the zone.
A brief discussion followed.
Matthies moved, seconded by Leonard, to recommend approval of the
change of zone from AG to IL and from BG to IL as it complies with the Comprehensive
Development Plan. Ballot: Ayes - Buller, Denny, Leonard, Johnson, Matthies, Gottsch, Wees
and Wear. Nays - none. Absent - Mangiamelli and Nichols. Motion carried.
4. Michael Smith, Deputy County Attorney for Sarpy County, proposes an
amendment to the Sarpy County Zoning Ordinances pertaining to an Agricultural Overlay
District.
Cindy Gilbert, recording secretary, read into record the letter Mike
Smith had sent to the planning commission in regards to an overlay district.
Mike Smith, Sarpy County Deputy Attorney, presented to the
commissioners, an overview of his idea for an Agricultural Overlay District. He indicated
that he had spoken to the area city officials and that they didn=t seem to have many concerns about this proposal.
Dan Pittman, Sarpy County Assessor, spoke about the State of Nebraska
working on a Bill to change agriculture values. The assessor=s office is looking to get this issue resolved.
Dwight Trumble explained that
approximately 200 acres of his land is already zoned Light Industrial and he does not wish
to pay taxes based on the zoning rather than the use on land he is presently farming.
Brenda Sedlacek of the City of LaVista,
expressed concern of not having a public hearing to remove the overlay zoning from the
land as proposed.
Joe Mangiamelli joined the meeting at 8:20
p.m.
Discussion between Dan Pittman, Mike
Smith, Ken Tex and the commissioners ensued including taxes and valuation of land.
Jarel Vinduska doesn =t think zoning should
change until the use itself changes.
No action was taken on this item. Further discussion and research
are needed before any action can be recommended.
There being no further business, Johnson moved, seconded by Matthies,
that the meeting be adjourned. By a unanimous oral vote, Chair Meyer declared the meeting
adjourned at 8:40 p.m.
