To The Sarpy County Board of Commissioners:
The Sarpy County Planning Commission held its regular monthly meeting
Wednesday, August 16, 2000 in the County Board Room at the Sarpy County
Courthouse, Papillion, Nebraska. Chair Meyer called the meeting to order at 7:30
p.m. with the following members present: Charles Denny, Bill Leonard, John
Johnson, Marcia Matthies, Denny Nichols, Tom Wees and Alan Wear. Absent was
Wendy Gottsch, Joe Mangiamelli and Charles Buller. Ken Tex, Sarpy County
Planning and Zoning Coordinator, Tamra Walz, Sarpy County Deputy Attorney and
Cindy Gilbert, Recording Secretary were also present.
Chair Meyer asked for any reports from commissioners. There were none.
Chair Meyer asked for a motion to approve the agenda as submitted. Johnson
moved, seconded by Wees to approve the agenda as submitted. Ballot: Ayes -
Leonard, Johnson, Matthies, Nichols, Wees and Wear. Nays - none. Abstain -
Denny. Absent - Buller, Gottsch and Mangiamelli. Motion carried.
Chair Meyer then asked for a motion to approve the minutes of the July 19,
2000 meeting as submitted. Johnson moved, seconded by Denny to approve
the minutes of the July 19, 2000 as submitted. Ayes - Denny, Leonard,
Johnson, Matthies, Nichols, and Wear. Nays - none. Abstain - Wees. Absent -
Buller, Gottsch, and Mangiamelli. Motion carried.
I. CONSENT AGENDA ITEMS:
None.
II. REGULAR AGENDA ITEMS:
1. Phillip Jennings, 2275 S 135th Circle, Omaha, requests
approval of a special use permit to build a dwelling in a BG zoning district
in accordance with Section 25.2.6 of the Sarpy County Zoning Regulations on
the following described property, to wit: Lot 1, Platte Valley, a subdivision
as platted, recorded and surveyed in Sarpy County, Nebraska. (216th
& Pflug Road)
Phillip Jennings stated he wanted to put his dwelling on the southeast
corner of this property.
Rita Gere asked where he intended to put his business.
Mr. Jennings indicated on a map that it would go on the northwest side of
the property.
Phil Gere asked if he would be building his house to be aesthetically
pleasing compared to the homes already in existence in Seven Hills Estates
to the west and north of Mr. Jennings property. He also wanted to know if it
would be an acceptable size.
He indicated that he would be happy to show his plans to Mr. Gere when he
gets them drawn up. He intends to locate his business there first. He
said he actually had two businesses and they each had two trucks, for a
total of 4 that would be driven in and out of there. The trucks would be
kept inside the building.
A question about how long the BG zone had been in effect there was
answered by Ken Tex. He indicated that it was zoned that way as much as 25
years ago.
Johnson moved, seconded by Nichols, to recommend approval of a special
use permit as long as Phillip Jennings owns the property as it complies with
the zoning regulations. Ballot: Ayes - Denny, Leonard, Johnson, Nichols,
Wees and Wear. Nays - none. Abstain - Matthies. Absent - Buller, Gottsch and
Mangiamelli. Motion carried.
2. Tonja Towne, 404 N. Jefferson, Papillion, Nebraska, requests approval
of a special use permit to operate an in-home beauty salon on the following
described property, to wit: Lot 27, Millard Park Replat V, a subdivision as
platted, surveyed and recorded in Sarpy County, Nebraska. (16427 Josephine
Street)
Tonja Towne introduced herself and explained that she would like to own
and operate this beauty salon in her home and that she would like to have
her sister, Michelle, work for her.
She indicated she understood that if she changed her operational plan,
she would have to come back to the Planning Commission to receive
permission.
Ken Tex stated that this salon had been brought before the commission
before under a different owner.
With no further questions, Wees moved, seconded by Wear, to recommend
approval of the special use permit as long as Tonja Towne owned and operated
the business as it complies with the zoning regulations. Ballot: Ayes -
Denny, Leonard, Johnson, Matthies, Nichols, Wees and Wear. Nays - none.
Abstain - none. Absent - Buller, Gottsch and Mangiamelli. Motion carried.
3. Valley Ridge Business Park Replat I, being a replat of Lots 2-5,
Valley Business Ridge Park, John Kottmann, agent. (142nd Street,
just north of Cornhusker)
No one was there to represent Valley Ridge. Ken Tex added that there have
been some lot line adjustments made, but he wasn =t
sure what else, if anything, they were going to need to do. He informed the
commissioners that they could table, approve or deny the application.
Nichols moved, seconded by Wees, to recommend the application be tabled
until the next regular meeting (September 20, 2000). Ballot: Ayes -
Denny, Leonard, Johnson, Matthies, Nichols, Wees and Wear. Nays - none.
Abstain - none. Absent - Buller, Gottsch and Mangiamelli. Motion carried.
4. Bob Dreessen, Thompson, Dreessen & Dorner, Inc. and Bill Morrison
of NP Dodge Real Estate Sales, Inc., requests approval of a change of zone
from AG to RD-50PD, AG to RS-72 and AG to BG on the following described
property, to wit: The NE1/4 of Sec 16, Twp 14N, Rng 11E and part of the
SE1/4 of Sec 16, Twp 14N, Rng 11E of the 6th P.M., Sarpy County,
Nebraska. (SW corner of 168th & Harrison)
Joe Mangiamelli joined the group at approximately 7:54 p.m.
Bob Dreessen, Thompson, Dreessen & Dorner, Inc., introduced himself
and Bill Morrison from NP Dodge Real Estate, Inc. as the representatives for
the subdivision, The Hamptons. He stated that this particular property was
platted and approved several years ago and except for some minor
modifications, the concept is essentially the same as always. He indicated
on a map where green space would be located as well as townhomes, duplexes,
single family homes and commercial businesses. He referred to comments from
Tom Lynam concerning a previous commitment to participate in the cost of
improvements to Harrison Street, which Mr. Dreessen agreed to comply. He
then addressed the letter received from the Papio-Missouri River Natural
Resource District. He proceeded to read the letter and respond to the
sections as he read them. He indicated that he has been in touch with the
NRD and would be working with them to meet all their requirements.
Don Meyer read into record the comments Tom Lynam had sent to the
commissioners.
Discussion continued on drainage from houses down to the creek, culverts,
erosion, ingress and egress.
5. Bob Dreessen, Thompson, Dreessen & Dorner, Inc. and Bill Morrison
of NP Dodge Real Estate Sales, Inc., requests approval of a preliminary plat
of a subdivision to be known as The Hamptons on the following described
property, to wit: The NE1/4 of Sec 16, Twp 14N, Rng 11E and part of the
SE1/4 of Sec 16, Twp 14N, Rng 11E of the 6th P.M., Sarpy County,
Nebraska. (SW corner of 168th & Harrison)
The question was asked about where the sewers
would drain. Mr. Dreessen stated that most of it would drain into Omaha=s
system, but that a portion could potentially be picked up by The City of
Gretna as its line becomes available.
Ken Tex responded by saying that sewer fees
collected would be distributed to the appropriate parties.
Wear moved, seconded by Wees, to recommend
approval of a change of zone from AG to RD-50PD, AG to RS-72 and AG to BG as
it meets the zoning regulations and is consistent with the comp plan. Ballot:
Ayes - Denny, Leonard, Johnson, Matthies, Mangiamelli, Nichols, Wees and Wear.
Nays - none. Abstain - none. Absent - Buller and Gottsch. Motion carried.
Nichols moved, seconded by Wear, to recommend
approval of a preliminary plat to include Tom Lynam=s request for cost sharing
of improvements to Harrison Street and the NRD=s requests be complied with as
it is consistent with the comp plan. Ballot: Ayes - Denny, Leonard, Johnson,
Matthies, Mangiamelli, Nichols, Wees and Wear. Nays - none. Abstain - none.
Absent - Buller and Gottsch. Motion carried.
III. CORRESPONDENCE:
Joe Mangiamelli brought up the fact that an
interlocal agreement between the City of Gretna and the City of Omaha had not
yet been made and maybe we shouldn=t take for granted that the City Council
will always be receptive to these agreements.
IV. ADJOURNMENT.
There being no further business, Wear
moved, seconded by Wees, to adjourn the meeting. By a unanimous oral vote,
Chair Meyer declared the meeting adjourned at 8:32 p.m.
