To The Sarpy County Board of Commissioners:
The Sarpy County Planning Commission held its regular monthly
meeting Wednesday, January 19, 2000 in the County Board Room at the Sarpy County
Courthouse, Papillion, Nebraska. Chair Meyer called the meeting to order at 7:30
p.m. with the following members present: Charles Buller, Charles Denny, Bill
Leonard, John Johnson, Wendy Gottsch, Joe Mangiamelli, Thomas Wees and Alan
Wear. Absent was Marcia Matthies and Dennis Nichols. Ken Tex, Sarpy County
Planning and Zoning Coordinator, Tamra Walz, Sarpy County Deputy Attorney and
Cindy Gilbert, Recording Secretary were also present.
Chair Meyer asked for any reports from commissioners. There
were none.
Chair Meyer asked for a motion to approve the agenda as
submitted. Johnson moved, seconded by Wees to approve the agenda as
submitted. Ballot: Ayes - Buller, Denny, Leonard, Johnson, Mangiamelli,
Gottsch, Wees and Wear. Nays - none. Absent - Matthies and Nichols. Abstain
- none. Motion carried.
Chair Meyer then asked for a motion to approve the
minutes as submitted. Johnson moved, seconded by Denny, to approve the
minutes of the December 15, 1999 meeting as submitted. Ballot: Ayes -
Buller, Denny, Leonard, Johnson, Mangiamelli, Gottsch, Wees and Wear. Nays -
none. Absent - Matthies and Nichols. Abstain - none. Motion carried.
1. Rashelle Fenger of 16219 Josephine Street, Omaha,
Nebraska requests approval of a special use permit to operate a home-based
beauty salon on the following described property, to wit: Lot 27, Millard Park
Replat V located in part of Sec 15, Twp 14N, Rng 11E of the 6th
P.M., Sarpy County, Nebraska. (163rd & Harrison)
Rashelle Fenger introduced herself and explained that they
were building a new home and wanted to put a beauty salon in. She briefly went
over the operational plan she had submitted.
Johnson moved, seconded by Denny to recommend approval of
the special use permit to operate a beauty salon as long as Rashelle owns
and operates it in this location. Ballot: Ayes - Buller, Denny, Leonard,
Johnson, Mangiamelli, Gottsch, Wees and Wear. Nays - none. Absent - Matthies
and Nichols. Abstain - none. Motion carried.
2. HearthStone Homes of 8425 Madison Street, Omaha,
Nebraska requests approval of a final plat on a subdivision to be known
as Hickory Ridge (Lots 274 - 562) located on part of Tax Lot 4 in the NW1/4 of
Sec 16, Twp 14N, Rng 11E of the 6th P.M., Sarpy County, Nebraska.

Troy Meyer from E & A Consulting represented
HearthStone Homes in requesting approval on the final plat for Hickory Ridge.
He added that some of the cul-de-sacs on the preliminary plat had been removed
as requested.
Andrew Vinckier owns a lot just south of Hickory Ridge and
said he welcomes the development, but has a concern with the water drainage.
He would like a definition of how HearthStone Homes intends to take care of
potential water problems.
Discussion about their subdivision agreement ensued. Tamra
Walz indicated that she had been in contact with Jeff Elliot of E & A
Consulting and they were working on an agreement.
Mangiamelli moved, seconded by Wees to recommend approval
of the final plat as it complies with the preliminary plat and the comp plan
with the provisions in the subdivision agreement to include (1) a fence be
erected along the south end of the subdivision, (2) a sidewalk constructed
along 180th Street when appropriate, (3) S.I.D #190 to share in
the cost of improvements to 180th Street according to the
surveyor =s
office, (4) to minimize the amount of water run-off during grading and
construction that would affect the commercial property to the south.
Ballot: Ayes - Buller, Denny, Leonard, Johnson, Mangiamelli, Gottsch,
Wees and Wear. Nays - none. Absent - Matthies and Nichols. Abstain - none.
Motion carried.
3. George & Eileen Samson of 12201 Schram Road, Papillion,
Nebraska requests a change of zone from AG to AGR and a preliminary/final plat
on a subdivision to be known as Samson Addition on the following described
property, to wit: A platting of part of the W1/2 of the SE1/4 of the SE1/4 of
Sec 31, Twp 14N, Rng 12E of the 6th P.M., Sarpy County, Nebraska.

Ken Tex, in Pat Sullivan =s
absence, represented George & Eileen Samson in requesting approval of a
change of zone from AG to AGR and a preliminary/final plat. He said that they
simply wish to separate the home and other buildings from the rest of the
farm. Ken explained that he recommended approval because it complies with the
comprehensive development plan.
Dan Seibold wanted clarification that all or just some of the
buildings would be separated from the farm.
Ken reiterated that the new lot would include all the
buildings.
Chair Meyer asked for a motion to recommend approval of
the change of zone. Mangiamelli moved, seconded by Leonard to approve the
change of zone from AG to AGR as it complies with the comp plan. Ballot:
Ayes - Buller, Denny, Leonard, Johnson, Mangiamelli, Gottsch, Wees and Wear.
Nays - none. Absent - Matthies and Nichols. Abstain - none. Motion carried.

and Wear. Nays - none. Absent - Matthies and Nichols. Abstain - none. Motion
carried.
Correspondence
Discussion began on the proposed changes to the zoning
regulations, subdivision regulations and amendments to the comp plan. The
question arose on how we should be publishing these in regards to how specific
we should be. Discussion also included when voting on individual items could and
should be done.
There being no further business, Johnson moved, seconded
by Leonard to adjourn the meeting. By a unanimous oral vote, Chair Meyer
declared the meeting adjourned at 8:20 p.m.
