To The Sarpy County Board of Commissioners:
The Sarpy County Planning Commission held its regular monthly
meeting Wednesday, June 21, 2000 in the County Board Room at the Sarpy County
Courthouse, Papillion, Nebraska. Chair Meyer called the meeting to order at 7:30
p.m. with the following members present: Charles Buller, Charles Denny, Bill
Leonard, John Johnson, Joe Mangiamelli, Marcia Matthies, Denny Nichols, Tom Wees
and Alan Wear. Absent was Wendy Gottsch. Ken Tex, Sarpy County Planning and
Zoning Coordinator, Tamra Walz, Sarpy County Deputy Attorney and Cindy Gilbert,
Recording Secretary were also present.
Chair Meyer asked for any reports from commissioners. There
were none.
Chair Meyer asked for a motion to approve the agenda as
submitted. Johnson moved, seconded by Wees to approve the agenda as submitted.
Ballot: Ayes - Buller, Denny, Leonard, Johnson, Matthies, Mangiamelli,
Nichols, Wees and Wear Nays - none. Abstain - none. Absent - Gottsch. Motion
carried.
Chair Meyer then asked for a motion to approve the minutes
as submitted. Joe Mangiamelli noted that he was not listed as being
present and asked for a correction. Correction was so noted. Nichols moved,
seconded by Buller to approve the minutes of the May 17, 2000 as corrected.
Ayes - Buller, Leonard, Johnson, Matthies, Mangiamelli, Nichols and Wees.
Nays - none. Abstain - Denny and Wear. Absent - Gottsch. Motion
carried.
I. REGULAR AGENDA ITEMS:
1. Rashelle Fenger, 16219 Josephine Street, Omaha, requests
approval of a special use permit to operate a home-based beauty salon on the
following described property to wit: Lot 317, Millard Park, a
subdivision as platted, recorded and surveyed in Sarpy County, Nebraska.
Cindy Gilbert read into read the letter received from
Rashelle Fenger requesting approval for a beauty salon. She indicated in her
letter that she was unable to be there, but wanted the commissioners to know
that everything except the address would remain the same as her previous
request.
Wees moved, seconded by Denny to recommend approval of
the special use permit as it complies with the zoning regulations. Ballot:
Ayes - Buller, Denny, Leonard, Johnson, Mangiamelli, Matthies, Nichols, Wees
and Wear. Nays - none. Abstain - none. Absent - Gottsch. Motion carried.
2. Al Haney of Metro Poured Wall, Inc., P. O. Box 45409,
Omaha, requests approval of a special use trailer permit to park a mobile
home for the purpose of an office for a period of two (2) years on the
following described property, to wit: Lot 15, Lite limited Industrial Condo
Park, a subdivision as platted, recorded and surveyed in Sarpy County,
Nebraska. (180th & Storage Road)
Al Haney of Metro Poured Wall, Inc. presented to the
commissioners his plans for the lot in reference. He stated that he is
leasing the lot to a company that sells and maintains mobile offices and
portable classrooms. He is asking for two (2) years, after which time, a
permanent building will be erected. He said that since this will be a
showcase installation from which they sell a product, he feels it will be
well done and maintained.
Denny Nichols asked Ken Tex how his office keeps track of
special use permits like this one so that when the two years is up, we have
a way of knowing that he either needs to reapply or put something permanent.
Ken indicated that a list is kept of when special use
permits expire and is followed up by his office and staff.
Johnson moved, seconded by Wees to recommend approval of
the special use trailer permit for two (2) years as it complies with the
County=s zoning regulations. Ballot: Ayes - Buller, Denny, Leonard, Johnson,
Matthies, Mangiamelli, Nichols, Wees and Wear. Nays - none. Abstain - none.
Absent Gottsch. Motion carried.
2. Richard & Brenda Ostransky, 8013 S. 225th
Street, Gretna, requests approval of a change of zone from AG to AGD &
AGR on the following described property, to wit: Tax Lot 9B, located in the
SE1/4 of the SW1/4 of Sec 14, Twp 14N, Rng 10E of the 6th P.M.,
Sarpy County, Nebraska. (225th & Giles Road)
3. Richard & Brenda Ostransky, 8013 S. 225th
Street, Gretna, requests approval of a preliminary/final plat for a
subdivision to be known as Ostransky Estates in the following described
property, to wit: Tax Lot 9B, located in the SE1/4 of the SW1/4 of Sec 14,
Twp 14N, Rng 10E of the 6th P.M., Sarpy County, Nebraska. (225th
& Giles Road)
Chair Meyer requested that Cindy Gilbert read into record
the letter received from the Richard & Brenda Ostransky. The letter
asked that their application for a change of zone and the preliminary/final
plat be withdrawn.
Mangiamelli moved, seconded by Matthies to remove agenda
items number 3 & 4 for a change of zone and a preliminary/final plat at
the request of the applicant. Ballot: Ayes - Buller, Denny,
Leonard, Johnson, Matthies, Mangiamelli, Nichols, Wees and Wear. Nays -
none. Abstain - none. Absent - Gottsch. Motion carried.
5. Dewayne & Joan Bohling, 223 S. Scott Street,
Gretna, requests approval of a change of zone from AG to IL on the following
described property, to wit: Part of the W1/2 of the NW1/4 of Sec 35, Twp
14N, Rng 11E of the 6th P.M., Sarpy County, Nebraska. (156th
& Shepard Street)
6. Glamis L.L.C., 4738 S. 131st Street, Omaha,
requests approval of a preliminary plat for a subdivision to be known as
Commerce Business Centre on the following described property, to wit: Part of
the W1/2 of the NW1/4 of Sec 35, Twp 14N, Rng 11E of the 6th P.M.,
Sarpy County, Nebraska. (156th & Shepard Street)
Bob Dreessen, Thompson, Dreessen and Dorner, Inc.,
represented the applicants and explained the plans for what they were
looking to do and where it is located. He stated that the State has limited
access from Highway 370, which is why Shepard Street was brought around to
eliminate 156th Street from coming off the highway. He indicated
that there would be a paved access from Highway 370 to Shepard, then west to
156th Street to the south end of the project. He said the land
use is appropriate and that this site is comparable to other plans in the
area.
Don Meyer read a statement from Tom Lynam, County
Surveyor, that stated access to Lot one (1) should be an extension of 153rd
Street; access to lot from subdivision road except Lot 11; Lot 12 should try
to access 153rd Street, but could possibly be on 156th
Street. Locations for access need to be approved by Highway Department and
that to vacate the Right Of Way, they will need to work with the State
Department of Roads and the County Highway Department.
Bob Dreessen said that Lot 1 will be an extension of 153rd
Street and he understands what Mr. Lynam is wanting and will work with him
on his requests.
Other areas of discussion included creating a basin on
the side of the road for water run-off and a buffer of trees between the
business center and the highways it borders.
John Yochum of the Sarpy County Economic Development
Corporation, said that it was obvious the developer and the engineers has
paid attention to what the County wants and was pleased to see that this
group had chosen to have larger lots.
Bob Dreessen indicated that the water would be serviced
by M.U.D. and the sewer would be conveyed to the Sarpy County Industrial
Sewer system.
Chair Meyer entertained a motion to include the request
for a tree buffer and the comments from Tom Lynam.
Nichols moved, seconded by Wear to recommend approval of
a change of zone from AG to IL as it complies with the comp plan. Ballot:
Ayes - Buller, Denny, Leonard, Johnson, Matthies, Mangiamelli, Nichols, Wees
and Wear. Nays - none. Abstain - none. Absent - Gottsch. Motion carried.
Nichols moved, seconded by Wear to recommend approval of
a preliminary plat as it complies with the comp plan with the stipulations
that a tree buffer be put along Highway 50 and Highway 370 and that Tom
Lynam=s comments be adhered to. Ballot: Ayes - Buller, Denny, Leonard,
Johnson, Matthies, Mangiamelli, Nichols, Wees and Wear. Nays - none. Abstain
- none. Absent - Gottsch. Motion carried.
Chair Meyer asked that the request for a H/A
(Horticultural/Agricultural) zoning district be put on the agenda, as it had
been tabled the previous meeting.
Nichols moved, seconded by Mangiamelli to bring the
tabled agenda items from the last meeting back to the current agenda for
action. Ballot: Ayes - Buller, Denny, Leonard, Johnson, Matthies,
Mangiamelli, Nichols, Wees and Wear. Nays - none. Abstain - none. Absent -
Gottsch. Motion carried.
7. Adopt a HA (Horticultural/Agricultural) zoning
district.
Dan Pittman, County Assessor, requested approval of this
zoning district. He indicated that an article that had appeared in The Times
newspaper had a quote in it from the State Office of Taxation and
Assessment. Dan indicated that the reporter for that article had received
more comment from the State office than he had been able to get previously.
He reiterated that he felt this would be a reasonable solution to a
potential problem between zoning and land use as he interprets the Statutes.
After considerable discussion, Nichols moved, seconded
by Wees to recommend approval of the HA zoning district, excluding the two
amendments, as it is a fair policy and adheres to the tax
regulations. Ballot: Ayes - Leonard, Matthies, Mangiamelli, Nichols,
Wees and Wear. Nays - Buller and Denny. Abstain - Johnson. Absent - Gottsch.
Motion carried.
II. CORRESPONDENCE:
Cindy Gilbert informed the commissioners that an agenda
item next month would include a presentation for a zoning ordinance pertaining
to landscaping.
With there being no further business, Chair Meyer called
for a motion to adjourn.
Nichols moved, seconded by Johnson to adjourn the meeting.
With a unanimous oral vote, Chair Meyer declared the meeting adjourned at 8:55
p.m.
