To The Sarpy County Board of Commissioners:
The Sarpy County Planning Commission held its regular monthly
meeting Wednesday, November 15, 2000 in the County Board Room at the Sarpy
County Courthouse, Papillion, Nebraska. Chair Meyer called the meeting to order
at 7:30 p.m. with the following members present: Charles Buller, Charles Denny,
Marcia Matthies, Joe Mangiamelli, Tom Wees and Alan Wear.. Absent was Wendy
Gottsch, John Johnson and Denny Nichols. Ken Tex, Planning & Zoning
Coordinator, Tamra Walz, Deputy County Attorney and Cindy Gilbert, Recording
Secretary were also present.
Chair Meyer asked for any reports from commissioners.
There were none.
Chair Meyer noted that Agenda Items # 1, 4 and 5 would be tabled at the
applicant =s
request and asked for a motion to approve the agenda as submitted. Wees moved,
seconded by Mangiamelli to approve the agenda as submitted. Ballot: Ayes -
Buller, Denny, Matthies, Mangiamelli, Wees and Wear. Nays - none. Abstain
-none. Absent - Johnson, Gottsch, and Nichols. Motion carried.
Chair Meyer then asked for a motion to approve the minutes
of the previous meeting as submitted. Matthies moved, seconded
by Mangiamelli to approve the minutes of the October 18, 2000 meeting as
submitted. Ayes - Buller, Denny, Matthies, Mangiamelli, Wees and Wear
Nays - none. Abstain - Leonard. Absent - Johnson, Gottsch, and Nichols. Motion
carried.
I. CONSENT AGENDA ITEMS:
None.
II. REGULAR AGENDA ITEMS:
1. Jerry Slusky, attorney for RF Wireless Systems, 2120 S. 72nd
St., #800, Omaha, requests approval of a special use permit to build a monopole
tower on the following described property to wit: That part of Lot 30B, Prairie
Corners, located in Sec 26, Twp 14N, Rng 11E of the 6th P.M., Sarpy
County, Nebraska. (147th & Custer Road) (Tabled from October 18
meeting)
Letters from Qwest and Jerry Slusky were read into record.
It was also noted that Mr. Slusky=s
office had called late in the afternoon requesting this application be tabled
until the December 20, 2000 meeting.
Mangiamelli moved, seconded by Wear to table the
application until the December 20, 2000 meeting. Ballot: Ayes - Buller,
Denny, Matthies, Mangiamelli, Wees and Wear. Nays - none. Abstain - none.
Absent - John Johnson, Wendy Gottsch and Denny Nichols. Motion carried.
2. Bill & Carita Mann, 13814 South 84th
Street, Papillion, request approval of a change of zone from AG to AGR on
the following described property, to wit: Being a platting of part of Tax
Lot 11, located in the E1/2 of the NW1/4 of Sec 14, Twp 13N, Rng 12E of the
6th P.M., Sarpy County, Nebraska. (SE corner of 84th
& Fairview Road)
Bill Mann indicated that this land was being used to
expand a private recreation facility to add new ballfields and some
additional parking.
Ken Tex added that, in speaking with Tom Lynam, the
Surveyor=s Office would have to
give approval of where access from 84th Street would be located.
Wees moved, seconded by Matthies recommend approval of
the change of zone as it meets the comprehensive development plan. Ballot:
Ayes - Buller, Denny, Matthies, Mangiamelli, Wees and Wear. Nays - none.
Abstain - none. Absent - Johnson, Gottsch and Nichols. Motion carried.
3. Bill & Carita Mann, 13814 South 84th
Street, Papillion, request approval of a preliminary/final plat for a
subdivision to be known as Crusader Complex on the following described
property, to wit: Being a platting of part of Tax Lot 11, located in the
E1/2 of the NW1/4 of Sec 14, Twp 13N, Rng 12E of the 6th P.M.,
Sarpy County, Nebraska. (SE corner of 84th & Fairview Road)
Chair Meyer asked if there were any other questions for
Mr. Mann and then called for a motion.
Matthies moved, seconded by Wear to recommend approval of
the preliminary/final plat as it complies with the comp plan with the
stipulation that access off 84th Street is approved by the County
Surveyor=s Office. Ballot: Ayes -
Buller, Denny, Matthies, Mangiamelli, Wees and Wear. Nays - none. Abstain -
none. Absent - Johnson, Gottsch and Nichols. Motion carried.
4. Jerry Slusky, agent for Frank J. Wear & others,
requests approval of a change of zone from RG-25 & BG to IL on the
following described property, to wit: Tax Lot 4, Sec 23, Twp 14N, Rng 11E of
the 6th P.M., except Meadows Blvd. and except that part platted
as Lakeview South and except that part platted as Lakeview South No. 7 and
Replat 1, and except those parts conveyed to the State of Nebraska for
Highway purposes, subject to Statutory Roads, in Sarpy County, Nebraska.
Chair Meyer read into record a letter from Jerry Slusky
requesting that the applications for the change of zone and the preliminary
plat be tabled until the December 20, 2000 meeting.
Wees moved, seconded by Mangiamelli to table this
application, at the request of the applicant, until the December 20, 2000
meeting. Ballot: Ayes - Buller, Denny, Matthies, Mangiamelli, Wees and Wear.
Nays - none. Abstain - none. Absent - Johnson, Gottsch and Nichols. Motion
carried.
5. Jerry Slusky, agent for Frank J. Wear & others,
requests approval of a preliminary plat for a subdivision to be known as
Chalco Crossing on the following described property, to wit: Tax Lot 4, Sec
23, Twp 14N, Rng 11E of the 6th P.M., except Meadows Blvd. and
except that part platted as Lakeview South and except that part platted as
Lakeview South No. 7 and Replat 1, and except those parts conveyed to the
State of Nebraska for Highway purposes, subject to Statutory Roads, in Sarpy
County, Nebraska.
Wees moved, seconded by Mangiamelli to table this
application, at the request of the applicant, until the December 20, 2000
meeting. Ballot: Ayes - Buller, Denny, Matthies, Mangiamelli, Wees and Wear.
Nays - none. Abstain - none. Absent - Johnson, Gottsch and Nichols. Motion
carried.
III. CORRESPONDENCE:
Ken Tex announced to the Planning Commission members that
the County Board of Commissioners would be holding a dinner in their honor.
The date has been tentatively set for December 13, 2000.
Charles Buller voiced his concerns about the number of cell
towers being constructed now and feels we need something in the ordinances
that ensures the owner will dismantle the tower when they have finished using
it.
Ken Tex added that the ground the towers sit on are usually
owned by someone else and thought that they would probably have something in
the lease agreement about its removal because it would be a liability to them,
but said that they could look into adding something into the ordinances.
IV. ADJOURNMENT:
Being no further discussion, Matthies moved, seconded by
Denny, to adjourn the meeting. By a unanimous oral vote, Chair Meyer declared
the meeting adjourned at 7:52 p.m.
