To The Sarpy County Board of Commissioners:
The Sarpy County Planning Commission held its
regular monthly meeting Wednesday, January 24, 2001 in the County Board Room at
the Sarpy County Courthouse, Papillion, Nebraska. Chair Meyer called the meeting
to order at 7:30 p.m. with the following members present: Charles Buller,
Charles Denny, Marcia Matthies, Don Meyer, Pam Buethe, Tom Wees and Alan Wear.
Absent was John Johnson, Denny Nichols and Joe Mangiamelli. Tamra Walz, Deputy
County Attorney was present. Ken Tex, Planning & Zoning Coordinator and
Cindy Gilbert, Recording Secretary, were also present.
Chair Meyer asked for any reports from
commissioners.
There were none.
Chair Meyer asked for a motion to approve
the agenda as submitted. Wear moved, seconded by Wees to the approve the
agenda as submitted. Ballot:
Ayes - Buller, Denny, Matthies, Buethe, Wees and Wear. Nays - none. Abstain
- none. Absent - Johnson, Nichols and Mangiamelli. Motion carried.
Chair Meyer asked for a motion to approve
the minutes of the previous meeting as submitted. Matthies moved, seconded
by Wear to approve the minutes of the December 27, 2000 meeting as
submitted. Ayes- Buller, Denny, Matthies, Buethe, Wees and Wear Nays- none.
Abstain - none. Absent- Johnson, Nichols and Mangiamelli. Motion carried.

II. REGULAR AGENDA ITEMS:
1. Richard & Brenda Ostransky, 8013 S. 225th
Street, Gretna, requests approval of a change of zone from AG to AGD & AGR
on the following described property, to wit: Tax Lot 9B, located in the SE1/4
of the SW1/4 of Sec 14, Twp 14N, Rng 10E of the 6th P.M., Sarpy
County, Nebraska. (225th & Giles Road)
Brenda Ostransky simply indicated they would
like to split their property to sell five acres.
Ken Tex explained where the property was
located and showed on the map where the easements were located on the
property. He also added that the driveway entrance would have to be approved
by the Surveyor's Office.
Wees moved, seconded by Buller to recommend
approval of the change of zone from AG to AGD & AGR as it complies with
the comp plan, with the stipulation that the driveway entrance be approved
by the County Surveyor. Ballot: Ayes - Buller, Denny, Matthies, Buethe, Wees
and Wear. Nays - none. Abstain - none. Absent - Johnson, Nichols and
Mangiamelli. Motion carried.
2. Richard & Brenda Ostransky, 8013 S.
225th Street, Gretna, requests approval of a preliminary/final
plat for a subdivision to be known as Ostransky Estates in the following
described property, to wit: Tax Lot 9B, located in the SE1/4 of the SW1/4 of
Sec 14, Twp 14N, Rng 10E of the 6th P.M., Sarpy County, Nebraska.
(225th & Giles Road)
Ken Tex reiterated the easements for
ingress/egress and stated that there is a house on one of the lots already.
Wees moved, seconded by Buller to recommend
approval of the preliminary/final plat for Ostransky Estates as it complies
with the zoning regulations and the comp plan. Ballot: Ayes - Buller, Denny,
Matthies, Buethe, Wees and Wear. Nays - none. Abstain - none. Absent -
Johnson, Nichols and Mangiamelli. Motion carried.
3. Kenneth Weber, 20080 West Highway 31, Springfield, requests approval
of a change of zone from AG to AGD on the following described property, to
wit: Being a replat of part of Tax Lot 1A1B1A, located in the SE 1/4 of the
NW 1/4 of Sec 18, Twp 12N, Rng 11E of the 6th P.M., Sarpy County,
Nebraska. (200th & West Highway 31)
Ken Weber stated that he owns 20 2 acres and
would like to split it in half and sell the other half.
Gary Richter, an adjoining property owner,
indicated he was concerned about running out of water with additional homes
in that area. He stated that the area is unique because it sits on a
limestone shelf and there isn't a tremendous amount of water. He said there
are already four houses on that aquifer.
Ken Weber said that his property seems to
sit on more sand that limestone and indicated that he doesn't have any water
problems now and doesn't anticipate any.
Wear moved, seconded by Buller to recommend approval of the change of
zone from AG to AGD because it complies with the comp plan. Ballot: - Ayes -
Buller, Denny, Matthies, Buethe, Wees and Wear. Nays - none. Abstain - none.
Absent - Johnson, Nichols and Mangiamelli. Motion carried.
4. Kenneth Weber, 20080 West Highway 31, Springfield, requests approval
of a preliminary/final plat for a subdivision to be known as Riverside
Estates on the following described property, to wit: Being a replat of part
of Tax Lot 1A1B1A, located in the SE 1/4 of the NW1/4 of Sec 18, Twp 12N,
Rng 11E of the 6th P.M., Sarpy County, Nebraska. (200th
& West Highway 31)
Wear moved, seconded by Buller to recommend approval of the
preliminary/final plat for Riverside Estates as
it complies with the comp plan and zoning regulations. Ballot: Ayes - Buller,
Denny, Matthies, Buethe, Wees and Wear. Nays - none. Abstain - none. Absent
- Johnson, Nichols and Mangiamelli. Motion carried.
5. Jeff Ray, Olmstead & Perry Consulting
Engineers, agent for Roger Stueckrath, requests approval of a change of zone
from AG to RS-72 on the following described property, to wit: Part of the N 2
of the SE 1/4 of Sec 16, Twp 14N, Rng 11E of the 6th P.M., Sarpy
County, Nebraska. (168th Street, 1/4 mile north of Giles)
Jeff Ray introduced himself as the agent for
this subdivision. He indicated this subdivision would be contiguous
with the existing developing in the area. He also said they would comply
with Tom Lynam, County Surveyor's, request as well as the Papio-Missouri
River NRD.
Don Meyer read into record Tom Lynam's
comments.
Jeff Ray went on to show on the plat where
Mr. Lynam's requests had already been addressed. Cedar Ridge Road has been
lowered to line up with Briar Street and Green Circle has been
eliminated. The streets will also be renamed where necessary.
Cindy Gilbert then read into record the letter from the NRD.
Chair Meyer then called for a motion to include the facts of finding.
Wear moved, seconded by Matthies to recommend approval of the change of zone
from AG to RS-72 as it complies with the comp plan with the stipulation that
the requests of the County Surveyor and the Papio-Missouri River NRD be met.
Ballot: Ayes - Buller, Denny, Matthies, Buethe, Wees and Wear. Nays - none.
Abstain - none. Absent - Johnson, Nichols and Mangiamelli. Motion carried.
6. Jeff Ray, Olmstead & Perry Consulting
Engineers, agent for Roger Stueckrath, requests approval of a preliminary plat
for a subdivision to be known as Cedar Ridge on the following described
property, to wit: Part of the N 2 of the SE 1/4 of Sec 16, Twp 14N, Rng 11E of
the 6th P.M., Sarpy County, Nebraska. (168th Street, 1/4
mile north of Giles)
With no further discussion, Wear moved, seconded by Matthies to recommend
approval of the revised drawing of the preliminary plat for Cedar Ridge as
it complies with the comp plan with the stipulation that they adhere to all
requests made by Tom Lynam, County Surveyor and the Papio-Missouri NRD.
Ballot: Ayes - Buller, Denny, Matthies, Buethe, Wees and Wear. Nays - none.
Abstain - none. Absent - Johnson, Nichols and Mangiamelli. Motion carried.
7. Bob Dean, agent for Main Street Partners, L.L.C., requests approval of
a change of zone from AG to RD-50PD, RS-72PD and BG on the following
described property, to wit: The NW 1/4 of Sec 17, Twp 14N, Rng 11E of the 6th
P.M., Sarpy County, Nebraska. (SE corner of 192nd & Harrison
Street)
Scott Brown, attorney representing Bob Dean and Main Street
Partners, gave statistics on the land and how they wanted to use it. They
are anticipating 336 single family homes, 3+ acres for town homes, 36+
acres to be used as commercial and 17+ acres for public park land (soccer
field, baseball field and playground. He also pointed out the trail
system that will run through the development.
Don Meyer read into record the comments from Tom Lynam, County
Surveyor.
Mr. Brown said they would meet the Surveyor's
requirements.
Scott Brown introduced the architect for the project, Randy Brown, who
said that their reason for the 20' setback was to create more of a community
effect, like the Dundee area of Omaha. He indicated that with the houses
sitting closer to the road, traffic tends to move slower through the
neighborhood.
Charles Buller voiced his concern about more
cars being parked on the street with shorter driveways and didn't think it
would slow traffic at all.
More discussion ensued regarding the PD (Planned Development) status,
particularly the 20' setback.
Cindy Gilbert read into record the letter from the NRD.
Rod Buethe, Gretna Fire Chief, expressed his
concern about only one exit in regard to emergency services. He also
stated he thought the streets should intersect more often so that emergency
vehicles don't have as far to go to turn around if they should have trouble
finding the house they are looking for.
Don Meyer asked Rod Buethe to put his concerns in writing.
Randy Sump asked if there were any plans in the near future to make
improvements to 192nd Street.
Ken Tex indicated that the County Highway Department would share
equally with the owners on both sides of the road when the time comes. Those
requirements are usually written into the subdivision agreements.
After more general discussion,
Buller moved, seconded by Denny to recommend approval of the change of
zone from AG to RD-50, RS-72 and BG, (not allowing the PD (Planned
Development) portion of the zone change) as it complies with
the comp plan. Ballot: Ayes - Buller, Denny, Matthies, Buethe, Wees and
Wear. Nays - none. Abstain - none. Absent - Johnson, Nichols and Mangiamelli.
Motion carried.
8. Bob Dean, agent for Main Street Partners, L.L.C., requests approval of
a preliminary plat for a subdivision to be known as Hoich Addition on the
following described property, to wit: The NW 1/4 of Sec 17, Twp 14N, Rng 11E
of the 6th P.M., Sarpy County, Nebraska. (SE corner of 192nd
& Harrison Street)
Buller moved, seconded by Wear to recommend
approval of the preliminary plat with the stipulation that they include and
meet the requirements of the Papio-Missouri River NRD and the County
Surveyor's Office as it complies with the comp plan. Ballot: Ayes - Buller,
Denny, Matthies, Buethe, Wees and Wear. Nays - none. Abstain - none. Absent
- Johnson, Nichols and Mangiamelli. Motion carried.
9. Bob Dreessen, Thompson, Dreessen &
Dorner, Inc., agent for Harrison Woods, L.L.C., requests approval of a final
plat for a subdivision to be known as Harrison Woods on the following
described property, to wit: Part of the NE 1/4 of Sec 16, Twp 14N, Rng 11E of
the 6th P.M., Sarpy County, Nebraska. (Appr. 2 mile south of
Harrison, from 168th east to 156th)
Bob Dreessen explained that the preliminary plat had shown an access from
the commercial and residential property onto Harrison Street. They had,
however, made a change to the final that would put residential access onto 168th
Street instead. He stated that he had already received approval from
Tom Lynam. He also indicated that Harrison Woods would be served by both
Gretna and Omaha sewer.
The letter from the NRD was read into record.
Wees moved, seconded by Wear to recommend approval of the Final Plat of
Harrison Woods with the stipulation that they comply with the requests of Tom
Lynam, County Surveyor, NRD, the State of Nebraska and the Army Corps of
Engineers. Ballot: Ayes - Buller, Denny, Matthies, Buethe, Wees and Wear. Nays
- none. Abstain - none. Absent - Johnson, Nichols and Mangiamelli. Motion
carried.
III. CORRESPONDENCE
Cindy Gilbert stated that Marcia Matthies term
on the Board of Adjustment had expired.
Don Meyer asked the Planning Commission
members what they wanted to do. By
a unanimous oral vote, Marcia Matthies was voted to retain that position.
Cindy Gilbert then introduced Pam Buethe as
the newest addition to the Planning Commission. She also introduced Donald
Fenster who has been appointed by Inez Boyd. He will begin his term in
February.
Ken Tex informed the commission that the
annual NPZA (Nebraska Planning & Zoning Association) conference
would be coming up March 28, 29 and 30 and invited them to attend
IV. ADJOURNMENT:
Being no further discussion, Wees moved,
second by Wear, to adjourn the meeting. By a unanimous oral vote, Chair Meyer
declared the meeting adjourned at 9:03 p.m.
