To The Sarpy County Board of Commissioners:

The Sarpy County Planning Commission held its regular monthly meeting Wednesday, March 21, 2001 in the County Board Room at the Sarpy County Courthouse, Papillion, Nebraska. Chair Meyer called the meeting to order at 7:30 p.m. with the following members present: Charles Buller, Charles Denny, John Johnson, Marcia Matthies, Don Meyer, Pam Buethe, Wayne Labart, Donald Fenster, Tom Wees and Alan Wear. Absent was Denny Nichols. Tamra Walz, Deputy County Attorney was present. Ken Tex, Planning & Zoning Coordinator and Cindy Gilbert, Recording Secretary, were also present.

There were no reports from commissioners.

Chair Meyer asked for a motion to approve the agenda as submitted. Johnson moved, seconded by Matthies to the approve the agenda as submitted. Ballot: Ayes - Buller, Denny, Fenster, Johnson, Labart, Matthies, Buethe, Wees and Wear. Nays - none. Abstain - none. Absent - Nichols. Motion carried.

Chair Meyer asked for a motion to approve the minutes of the February 21, 2001 meeting. Wees moved, seconded by Buethe to approve the minutes as submitted. Ayes- Buller, Denny, Fenster, Labart, Matthies, Buethe, Wees and Wear Nays- none. Abstain - Johnson. Absent- Nichols. Motion carried.

 

I. CONSENT AGENDA ITEMS:

II. REGULAR AGENDA ITEMS:

1. Deborah Nichols, 2758 Dean Circle, Omaha, requests approval of a change of zone from AG to AGD on the following described property, to wit: Being a platting of part of the S1/2 of the NW1/4 and part of the NE1/4 of the SW1/4 of Sec 19, Twp 13N, Rng 13E of the 6th P.M., Sarpy County, Nebraska. (East side of 57th Street, 2 mile south of Platteview Road)

Deborah Nichols introduced herself and explained that three families had gone in together to purchase approximately 35 acres to be divided into 10+ acre lots. All three families intend to build homes on these lots. That property is located about 1/4 mile north of Riverview Forest.

It was noted that the County Surveyor=s Office would have to approve the driveway access off 57th Street.

Wees moved, seconded by Matthies to recommend approval of a change of zone from AG to AGD as it meets the comp plan. Ballot: Ayes - Buller, Denny, Fenster, Johnson, Matthies, Labart, Buethe, Wees and Wear. Nays - none. Abstain - none. Absent - Nichols. Motion carried.

2. Deborah Nichols, 2758 Dean Circle, Omaha, requests approval of a preliminary plat on a subdivision to be known as BNZ Place on the following described property, to wit: Being a platting of part of the S1/2 of NW1/4 and part of the NE1/4 of the SW1/4 of Sec 19, Twp 13N, Rng 13E of the 6th P.M., Sarpy County, Nebraska (East side of 57th Street, 2 mile south of Platteview Road)

Labart moved, seconded by Johnson to recommend approval of a preliminary plat on a subdivision to be known as BNZ Place as it complies with the Sarpy County Subdivision Regulations on the condition that the Sarpy County Surveyor=s Office approves the driveway access. Ballot: Ayes - Buller, Denny, Fenster, Johnson, Matthies, Labart, Buethe, Wees and Wear. Nays - none. Abstain - none. Absent - Nichols. Motion carried.

3. Recommend a landscaping ordinance to the Sarpy County Zoning Ordinances.

Ken Tex explained that a longer version of this proposal was sent back to the Planning Commission by the Board of Commissioners because it was too lengthy and detailed. It originally had about 14 pages and has since been cut down to approximately nine pages.

Tom Wees indicated that the list that contained the types of plants and trees to be used was eliminated. The proposed ordinance is still very direct on other requirements as far as building design, architecture and maintenance.

Charles Buller stated his concerns on making someone change the look of the building just because they don=t happen to like the way it looks.

John Yochum thinks this proposal is good, as written, and feels the developers will appreciate a guideline to use as they begin their planning.

Considerable discussion took place regarding this proposal with relationship to who was going to decide if the architecture was compatible with its surroundings and enforcement of such a plan. The amount of detail in the proposal was also discussed.

Ken Tex indicated that he would be the one reviewing the plans and suggested that maybe a small group of people might be better.

Wear moved, seconded by Johnson to recommend approval of the landscape ordinance, as written, with Don Meyer and Tom Wees presenting the proposal to the County Board of Commissioners. Ballot: Ayes - Buller, Denny, Fenster, Johnson, Matthies, Labart, Buethe, Wees and Wear. Nays - none. Abstain - none. Absent - Nichols. Motion carried.

 

III. CORRESPONDENCE:

Joe Mastandrea, Sarpy County Emergency Management Agency, discussed placement of sirens in new subdivisions as well as other areas where there is no coverage as of yet.

The Planning Commission felt that Emergency Management should confer with the local fire chiefs to make sure areas are covered as they should be.

Ken Tex talked about plan review fees for subdivisions indicating a need to reduce the fees for smaller subdivisions. The proposal is to charge the customary $5,000.00 for subdivisions with 100 or more lots and $50.00 per lot for subdivisions with 1 to 99 lots.

After some discussion concerning charging those fees at all, the general consensus was to recommend to the Board of Commissioners Ken=s proposal.

Ken Tex, speaking on behalf of Ron Patterson, said that Ron was wanting to sell off a portion of his property that was divided by a county road. The amount of land does not match the comp plan, but there are a few other pieces of ground adjacent to his property that are already smaller than the comp plan calls for.

The commissioners thought, under these circumstances, that an exception could be made to change the comp plan. They advised Ken that Mr. Patterson should go ahead and submit an application.

Tamra Walz indicated that someone had approached her with the idea that a fee for a flood plain permit should be charged. She said that this could be a way of offsetting costs for rescues in flood prone areas.

The Papio-Missouri River Natural Resources District would like to see, added to our ordinances, the setback requirements that the NRD sets for areas near waterways.

Tim Schram reported to the commissioners that Thompson, Dreessen & Dorner, Inc. had been retained to do a sewer study of the area that the Wood Hollow sewer serves.

Tim Schram also indicated that the county is getting closer to a GIS system in place and the cities have been contacted to see if they have an interest in participating.

 

IV. ADJOURNMENT:

Being no further discussion, Wees moved, second by Buethe, to adjourn the meeting. By a unanimous oral vote, Chair Meyer declared the meeting adjourned at 9:50 p.m.
