Commissioners:
The Sarpy County Planning
Commission held its regular monthly meeting Wednesday, November 21, 2001 in the
County Board Room at the Sarpy County Courthouse, Papillion, Nebraska. Chair
Meyer called the meeting to order at 7:30 p.m. with the following members
present: Pam Buethe, Charles Denny, Donald Fenster, John Johnson, Wayne LaBart,
Don Meyer, Tom Wees and Alan Wear. Tamra Walz, Deputy County Attorney was
present. Ken Tex, Planning & Zoning Coordinator and Cindy Gilbert, Recording
Secretary, were also present.
Chair Meyer asked for
commissioner reports. There were none.
Chair Meyer asked for a motion
to approve the agenda as submitted. Johnson moved, seconded by Buethe to
approve the agenda as submitted. Ballot:
Ayes - Buethe, Denny, Fenster, Johnson, LaBart, Wees and Wear. Nays - none.
Abstain - none. Absent - Buller, Matthies and Nichols. Motion carried.
Chair Meyer asked for a motion
to approve the minutes of the October 17, 2001 meeting. Wees moved, seconded
by Denny to approve the minutes as submitted. Ballot: Ayes- Buethe, Denny,
Fenster, Johnson, Wees and Wear. Nays - none. Abstain - LaBart. Absent -
Buller, Matthies and Nichols. Motion carried.

CONSENT AGENDA ITEMS:
None.
II. REGULAR AGENDA ITEMS:
1. Martin Ostransky, 22401 Harrison, Gretna, requests
approval of a Final Plat on a subdivision to be known as Sunset Ridge (Lot 4)
on the following described property, to wit: Being a platting of part of Tax
Lot 9, located in the S1/2 of the NE1/4 of Sec 22, Twp 14N, Rng 10E of the 6th
P.M., Sarpy County, Nebraska. (234th & Cary)
Jack Koke introduced himself as the representative for
Martin Ostransky and stated that Martin was looking to final the plat for
Lot 4 of Sunset Ridge.
Don Meyer read Tom Lynam's
comments regarding that lot becoming part of the maintenance agreement to
maintain 234th Street.
(4) Wear moved, seconded by Fenster to recommend approval
of the Final Plat for Lot 4 of Sunset Ridge as it meets the comp plan and
complies with the zoning regulations with the stipulation that Lot 4 become
part of the maintenance agreement to maintain 234th Street.
Ballot: Ayes - Denny, Fenster, Johnson, LaBart, Buethe, Wees and Wear. Nays
- none. Abstain - none. Absent - Buller, Matthies and Nichols. Motion
carried.
2. R & M Realty, 21757 Platteview Road, Gretna,
requests approval of a Final Plat on a subdivision to be known as R & M
Business Park on the following described property, to wit: Being a platting
of part of the NE1/4 of Sec 23, Twp 13N, Rng 10E of the 6th P.M.,
Sarpy County, Nebraska. (SW corner of Platteview Road & State Highway
31)
Jeff Elliott, E & A Consulting Group, Inc.,
represented R & M Realty. He stated the Final had been changed only
slightly from the Preliminary and added that they had complied with the
recommendation to grant a permanent easement on the west end of the
subdivision.
(2) LaBart moved, seconded by Wear to recommend approval of
the Final Plat for R & M Business Park as it complies with the comp plan
and zoning regulations. Ballot: Ayes - Denny, Fenster, Johnson, LaBart, Buethe,
Wees and Wear. Nays - none. Abstain - none. Absent - Buller, Matthies and
Nichols. Motion carried.
3. Charles & Marci Zegers,
22501 Ruff Road, Gretna, requests approval of a Final Plat on a subdivision to
be known as Cedar Hollow on the following described property, to wit: Being a
platting of part of Tax Lot 3A, located in the SE1/4 of Sec 16, Twp 14N, Rng 11E
of the 6th P.M., Sarpy County, Nebraska. (168th Street, 2
mile north of Giles)
Jeff Elliott, E & A Consulting Group, Inc., represented
Chuck and Marci Zegers. He requested approval of the Final Plat for the
subdivision Cedar Hollow. He indicated the temporary turnaround in the
cul-de-sac would meet the minimum standards required for cul-de-sacs. He
addressed the concerns of the Papio-Missouri River Natural Resource District (NRD).
1) Mr. Elliott said that the permanent easement will be granted to the SID. 2
& 3) Mr. Elliott indicated that an analysis had been performed and the
only tract of land in that subdivision that is in the flood plain is an outlot,
alleviating the need to delineate the Zone A flood plain designation on the
final plat, and 4) storm drain systems will be sent to the NRD when they are
designed.
Cindy Gilbert read into record the comments by the Gretna
Fire Chief.
The questioned was raised concerning the storm drain
systems not being approved by the NRD yet.
Ken Tex explained that those
systems are not generally designed ahead of time because of the cost. They are
typically sent to the County Engineer and the NRD after the Final Plat has been
approved. He indicated they didn't need to be a part of the Planning Commission's
recommendation since they will be taken care of by the County Engineer.
Discussion was held concerning
the fire hydrant spacing of 300' - 350' by the Gretna Fire Chief and M.U.D.'s
standards. Ken Tex suggested that the spacing be no more than 450' as
recommended by the Fire Chief Committee.
It was agreed by Jeff Elliott to abide by that request.
(3) Wear moved, seconded by
Wees to recommend approval of the Final Plat for Cedar Hollow as it meets
the zoning regulations with the stipulation that the NRD's requests are met,
the temporary turn around meets standard cul-de-sac requirements and the
hydrant spacing meets M.U.D. standards. Ballot: Ayes - Denny, Fenster,
Johnson, LaBart, Wees and Wear. Nays - Buethe. Abstain - none. Absent -
Buller, Matthies and Nichols. Motion carried.
4. Harrison Woods, L.L.C., 8701 West Dodge Road, Omaha,
requests approval of Preliminary/Final Plat on a subdivision to be known as
Harrison Woods Replat I on the following described property, to wit: Being a
replatting of Lots 134 -142, inclusive, and that part of 171st
Street lying between said Lots 134 & 135, all in Harrison Woods, a
subdivision in Sarpy County, Nebraska. (171st & Emiline)
Doug Dreessen, Thompson, Dreessen & Dorner, Inc.,
represented Harrison Woods. He stated that 171st Street is no
longer a connecting street from the residential area to the commercial. It
is now a walkway. He indicated the drainage way was being disrupted as
well as the nature trail.
After a brief discussion with Ken Tex, he also
concurred with Ken that leaving the road there would create additional
traffic within the subdivision from Hickory Ridge residents.
It was agreed that the bulk of the traffic should stay
on the main thoroughfares instead of the residential streets.
(4) Fenster moved, seconded by LaBart to recommend
approval of Harrison Woods Replat I as it meets the comp plan and conforms
to the Preliminary/Final Plat with the exception of 171st
Street being a public access to the commercial area of Harrison Woods.
Ballot: Ayes - Denny, Fenster, Johnson, LaBart, Buethe, Wees and Wear.
Nays - none. Abstain - none. Absent - Buller, Matthies and Nichols. Motion
carried.
5. Springfield Lake Development, 13004 Cottonwood Lane,
Springfield, requests approval of a Final Plat on a subdivision to be
known as Villa Springs Replat I on the following described property, to
wit: Being a replatting of Lots 76 - 89, inclusive, and Outlots J & M,
Villa Springs, located in Sec 31, Twp 13N, Rng 12E of the 6th
P.M., Sarpy County, Nebraska. (Buffalo Road & East Lake Drive)
Art Beccard, Thompson, Dreessen & Dorner, Inc.,
represented Springfield Lake Development. He stated that the Final Plat
conforms to the Preliminary Plat and requested approval.
Comments from the NRD and
the County Surveyor's Office were read.
(5) Labart
moved, seconded by Wees to recommend approval of the Final Plat for
Villa Springs Replat 1 as it meets the comp plan and zoning regulations as
long as the NRD requests are met and the County Surveyor's request is met.
Ballot: Ayes - Denny, Fenster, Johnson, LaBart, Buethe, Wees and Wear. Nays
- none. Abstain - none. Absent - Buller, Matthies and Nichols. Motion
carried.
6. James Cervantes, 302 Forest Drive, Bellevue, requests
approval of a Change of Zone from AG to AGD on the following described
property, to wit: Being a platting of part of the NW1/4 of Sec 19, Twp 13N,
Rng 13E of the 6th P.M., Sarpy County, Nebraska. (West side of 57th,
1/4 mile south of Platteview)
7. James Cervantes, 302 Forest Drive, Bellevue, requests
approval of a Preliminary/Final Plat on a subdivision to be known as Cervantes
Addition on the following described property, to wit: Being a platting of part
of the NW1/4 of Sec 19, Twp 13N, Rng 13E of the 6th P.M., Sarpy
County, Nebraska. (West side of 57th, 1/4 mile south of Platteview)
James Cervantes explained he
owned approximately 37 acres and wished to plat 10 acres of that. He indicated
that the driveway location had already been approved by the County Surveyor's
Office.
(6) LaBart moved, seconded by Buethe to recommend
approval of the Change of Zone from AG to AGD as it meets the comp plan.
Ballot: Ayes - Denny, Fenster, Johnson, LaBart, Buethe, Wees and Wear. Nays
- none. Abstain - none. Absent - Buller, Matthies and Nichols. Motion
carried.
(7) LaBart moved, seconded by Buethe to recommend
approval of the Preliminary/Final Plat as it meets the subdivision
regulations. Ballot: Ayes - Denny, Fenster, Johnson, LaBart, Buethe, Wees
and Wear. Nays - none. Abstain - none. Absent - Buller, Matthies and
Nichols. Motion carried.
8. Sarpy County Planning
Commission will consider delegating its authority to review and comment on
proposed subdivision plats for cities of the first and second class pursuant to
Nebraska State Statutes '' 16-902 and 17-1002.
Ken Tex explained that
according to Nebraska State Statute, cities of the first and second class are
required to submit subdivision plats, located within their extra territorial
jurisdiction, to the County Planning Commission for review and comment. He
stated that the county's interest lies more in infrastructure and sewer
connection fees than the layout and design of the subdivision. He indicated he
would be conferring with Mark Wayne, Brian Hanson and Tom Lynam on these
plats. Ken asked that the Planning Commission delegate its authority to review
these plans to the County Planning & Building Department. He indicated he
did not want to hold up the developers since the Planning Commission only
meets once a month.
Tamra Walz was asked if this
was legal to do. She stated that there was no reason why it can't be done this
way.
(8) Fenster moved, seconded by Wees to approve the
delegation of authority from the Planning Commission to the County Planning
and Building Department to review and comment on subdivision plats from cities
of the first and second class within their extra territorial jurisdiction
pursuant to Nebraska State Statutes. Ballot: Ayes - Denny, Fenster, Johnson,
LaBart, Buethe, Wees and Wear. Nays - none. Abstain - none. Absent - Buller,
Matthies and Nichols. Motion carried.
III. CORRESPONDENCE:
Tamra Walz gave an update of the County Board of
Commissioners November 13 meeting indicating that the County Board approved
all the zoning agenda items. She also informed the commissioners that the
pending annexation for the City of Papillion had been voted in favor of by the
City Council, only to be vetoed by the Mayor. She stated the City Council was
unable to override the veto. The County Board of Commissioners also voted to
challenge the annexation recently done by the City of Gretna.
IV. ADJOURNMENT:
Being no further discussion, Buethe
moved, seconded by Johnson, to adjourn the meeting. By a unanimous oral vote,
Chair Meyer declared the meeting adjourned at 8:45 p.m.
