Commissioners:
The Sarpy County Planning
Commission held its regular monthly meeting Wednesday, February 20, 2002 in the
County Board Room at the Sarpy County Courthouse, Papillion, Nebraska. Chair
Meyer called the meeting to order at 7:30 p.m. with the following members
present: Pam Buethe, Don Fenster, Tom Hurley, Brenda Kunz, Wayne LaBart, Don
Meyer, Alan Wear and Tom Wees. Absent were Marcia Matthies and Denny Nichols.
Tamra Walz, Deputy County Attorney was present. Ken Tex, Planning & Zoning
Coordinator and Cindy Gilbert, Recording Secretary, were also present.
Chair Meyer asked for
commissioner reports. There were none.
Chair Meyer asked for a motion
to approve the agenda as submitted. Wees moved, seconded by Wear to approve
the agenda as submitted. Ballot:
Ayes - Buethe, Fenster, Hurley, Kunz, LaBart, Wear and Wees. Nays -
none. Abstain - none. Absent - Matthies and Nichols. Motion carried.
Chair Meyer asked for a
motion to approve the minutes of the January 16, 2002 meeting. LaBart moved,
seconded by Buethe to approve the minutes as submitted. Ballot: Ayes - Buethe,
Fenster, Hurley, Kunz, LaBart, Wear and Wees. Nays - none. Abstain - none.
Absent - Matthies and Nichols. Motion carried.

CONSENT AGENDA ITEMS:

II. REGULAR AGENDA ITEMS:
1. Double AS@ Development,
23232 Highway 6, Gretna requests approval of a Preliminary/Final Plat on a
subdivision to be known as Double AS@ Development on the following described
property, to wit: Being a platting of part of the S1/2 of the SE1/4 of Sec 15,
Twp 13N, Rng 10E of the 6th P.M., Sarpy County, Nebraska. (228th
& W. Highway 6, north side)
Ken Tex gave an overview stating that the applicants own
the entire piece of ground where Big Rig is. They would like to sell off
approximately 4 acres where the existing building sits and build a new
building. They will share an existing driveway. He also indicated that no
change of zone was necessary. It is already properly zoned.
Chris Smisek, Double AS@
Development, stated that the smaller piece of ground they wanted to sell was
about 4 acres in size and asked the planning commission to approve their
request.
Wees moved, seconded by
LaBart to recommend approval of the Preliminary/Final Plat for Double AS@
Development as it meets the comp plan and zoning requirements. Ballot: Ayes
- Buethe, Fenster, Hurley, Kunz, LaBart, Wear and Wees. Nays - none. Abstain
- none. Absent - Matthies and Nichols. Motion carried.
2. M & H Enterprises, L.L.C., 1230 Dunbar Road,
Fremont requests approval of a Preliminary/Final Plat on a subdivision to be
known as M & H Acres on the following described property, to wit: Being
a platting of part of Tax Lot 15, located in the SE1/4 of Sec 14, Twp 13N,
Rng 10E of the 6th P.M., Sarpy County, Nebraska. (219th
& Platteview Road)
Ken Tex explained that this was the area where Detector
Dogs International used to be. He indicated that there is already an
office building there that will be used for M & H Investments to
relocate their business. Ken also stated that the Right-Of-Way for future
road improvements is already there as well.
Jay Muller, M & H Enterprises, said they have a
sign business in Blair and would like to move to this area and eventually
expand their business to employ up to 25 people.
LaBart moved, seconded by Buethe to recommend approval
of a Preliminary/Final Plat for M & H Acres as it complies with the
comp plan and zoning regulations. Ballot: Ayes - Buethe, Fenster, Hurley,
Kunz, LaBart, Wear and Wees. Nays - none. Abstain - none. Absent -
Matthies and Nichols. Motion carried.
3. Ballena Limited Partnership, 9749 S. 175th
Circle, Omaha requests approval of a Change of Zone from RS-72 to RE 1 on
the following described property, to wit: Being a replat of Lots 123
through 184, inclusive, Ballena, located in the E1/2 of Sec 28, Twp 14N,
Rng 11E of the 6th P.M., Sarpy County, Nebraska. (168th
& Ridgemont Street)
4. Ballena Limited Partnership, 9749 S. 175th
Circle, Omaha requests approval of a Preliminary Plat on a subdivision to
be known as Ballena Estates on the following described property, to wit:
Being a replat of Lots 123 through 184, inclusive, Ballena, located in the
E1/2 of Sec 28, Twp 14N, Rng 11E of the 6th P.M., Sarpy County,
Nebraska. (168th & Ridgemont Street)
Cindy Gilbert read into record the letter from
Hill-Farrell Associates, Inc. indicating that the purchase contract
entered into by their client may not be valid and wishes to table their
application until the issue is resolved.
Wees moved, seconded by
Buethe to table the application for a Change of Zone by Ballena Limited
Partnership until next meeting.
Ballot: Ayes - Buethe, Fenster, Hurley, Kunz, LaBart, Wear and Wees. Nays -
none. Abstain - none. Absent - Matthies and Nichols. Motion carried.
Buethe moved, seconded by
LaBart to table the application for a Preliminary Plat for Ballena Estates
until the next meeting. Ballot: Ayes - Buethe, Fenster, Hurley, Kunz, LaBart,
Wear and Wees. Nays - none. Abstain - none. Absent - Matthies and Nichols.
Motion carried.
5. David Vermeulen, 7109 Florence Street, LaVista requests
approval of Special Use Permit to amend the operational plan on the following
described property, to wit: Tax Lots 1 & 2, located in Sec 10, Twp 13N,
Rng 11E of the 6th P.M., Sarpy County, Nebraska. (156th
& Fairview Road)
David Vermeulen said he wished to amend his original
operational plan to utilize the facility for social gatherings and hay rack
rides expanding the season through the rest of the year.
The operational plan submitted by Mr. Vermeulen was read
into record.
David Vermeulen is anticipating a liquor license so that
the social gatherings will be allowed to bring in their own liquor. He said
the hours for parties would be until about 10 p.m. on week nights and
midnight or 1 a.m. on weekends. He stated that there would be music, but he
would not allow live bands. He said the building is insulated and that
should help control noise.
Terry Hughes, 15802 Fairview Road, stated that Mr.
Vermeulen lives directly east of him. His concerns with the application are
sparks from the pit fires igniting his wood and mulch. He is also concerned
about parties where there is alcohol consumption. He also feels they would
be too loud.
Eileena Stovall, 15510 Fairview Road, also voiced her
concern about the risk of fire, alcohol consumption and noise pollution.
Mr. Vermeulen doesn=t
anticipate any fire hazard. The pits are located directly behind his building
surrounded by gravel.
After considerable discussion,
Wees moved, seconded by Fenster to table the Special Use
Permit until a detailed, written operational plan can be submitted for
review by the Planning Commission. Ballot: Ayes - Buethe, Fenster, Hurley,
Kunz, LaBart, Wear and Wees. Nays - none. Abstain - none. Absent - Matthies
and Nichols. Motion carried.
6. DCL Enterprises, Inc., 1715 S. 167th
Circle, Omaha requests approval of a Special Use Permit to operate a
seasonal recreational establishment on the following described property, to
wit: The SE1/4 of Sec 16, Twp 14N, Rng 11E of the 6th P.M., Sarpy
County, Nebraska. (174th & Giles Road)
*Tom Hurley declared a conflict of interest and stated he
would abstain from participation.*
Don Losole introduced himself saying he is interested in
putting a haunted attraction in this location. He currently owns and
operates one in Omaha. This structure would be a 42' x 99' pole barn with
fire retardant throughout. The season would last from September 28 through
October 31. Hours of operation would be Sunday - Thursday until 10:30 p.m.
and Friday - Sunday until 11:30 p.m. He would employ 25 - 75 people. The
restrooms would be handicap accessible. He would also like to have a corn
maze with security observation towers. There will be a lit parking lot. The
entire area would be fenced in. He is also willing to participate in dust
control for Giles Road. He indicated he had signed a five year lease.
Wees moved, seconded by Wear to recommend approval of a
Special Use Permit to operate a seasonal business for five years as it
complies with the zoning regulations. Ballot: Ayes - Buethe, Fenster, Kunz,
LaBart, Wear and Wees. Nays - none. Abstain - Hurley. Absent -
Matthies and Nichols. Motion carried.
III. CORRESPONDENCE:
Tamra Walz updated the
Planning Commission on the County Board=s actions from the previous meeting.
Cindy Gilbert handed out information on the Nebraska
Planning & Zoning Conference being held in March.
Ken Tex noted he had met with area Planners and they have
decided to host a workshop for area Planning Commission members. He will have
additional information as it becomes available.
IV. ADJOURNMENT:
Being no further discussion, Buethe
moved, seconded by Wear, to adjourn the meeting. By a unanimous oral vote, Chair
Meyer declared the meeting adjourned at 9:05 p.m.
