Commissioners:
The Sarpy County Planning
Commission held its regular monthly meeting Wednesday, July 17, 2002 in the
County Board Room at the Sarpy County Courthouse, Papillion, Nebraska. Chair
Meyer called the meeting to order at 7:30 p.m. with the following members
present: Don Fenster, Brenda Kunz, Tom Hurley, Wayne LaBart, Marcia Matthies,
Don Meyer, Denny Nichols, Alan Wear and Tom Wees. Absent was Pam Buethe and Doug
Whitfield. Tamra Madsen, Deputy County Attorney was present. Cindy Gilbert,
Recording Secretary, was also present.
Chair Meyer asked for
commissioner reports. There were none.

7:32 p.m.*
Chair Meyer asked for a motion
to approve the agenda as submitted. Wees moved, seconded by LaBart to approve
the agenda as submitted. Ballot: Ayes - Fenster, Hurley, Kunz, LaBart,
Matthies, Nichols, Wear and Wees. Nays - none. Abstain - Whitfield. Absent -
Buethe. Motion carried.
Chair Meyer asked for a motion
to approve the minutes of the June 19, 2002 meeting. Wear moved, seconded by
Matthies to approve the minutes as submitted. Ballot: Ayes - Hurley, LaBart,
Matthies, Nichols, Wear, Wees and Whitfield. Nays - none. Abstain - Fenster
and Kunz. Absent - Buethe. Motion carried.

CONSENT AGENDA ITEMS:
None.
II. REGULAR AGENDA ITEMS:
1. Dale Harder, 15802 Schram
Road, Gretna, requests approval of a Change of Zone from AG to AGD on the
following described property, to wit: Being a platting of part of the SE1/4 of
Sec 34, Twp 14N, Rng 11E of the 6th P.M., Sarpy County, Nebraska.
(156th & Schram)
Chair Meyer stated that this
agenda item would also need an amendment to the comprehensive plan with
respect to the future land use map.
Stu Sutherland introduced
himself as the representative for Mr. & Mrs. Dale Harder. He stated this
platting was being done for the purpose of estate planning. Their land is
divided by the Interstate leaving approximately 150 acres on the south side
of the Interstate. This is where they want to separate 10 acres from the
rest of the farm because this is where the homestead is. All the property
will eventually be divided among the Harder= s children.
Denny Nichols asked if we
could have gone with 20 acres instead and questioning the minimum lot size
in a commercial zone.
Cindy Gilbert responded by
saying that the minimum lot size in a commercial zone was 10,000 square feet
and that the ten acres was appropriate in that respect.
Tom Hurley asked where the
nearest active commercial property is.
Mr. Sutherland indicated it
lies approximately one-half mile north of this property. He also stated they
have added the 50' street dedication to the plat.
Matthies moved, seconded
by LaBart to recommend approval of an amendment to the Comprehensive Plan
to change it from Commercial/Industrial to Transitional Agricultural
because it is the existing homestead and it is fitting to the area.
Ballot: Ayes - Fenster, Hurley, Kunz, LaBart, Matthies, Nichols, Wear,
Wees and Whitfield. Nays - none. Abstain - none. Absent - Buethe. Motion
carried.
Matthies moved, seconded
by Nichols to recommend approval of the Change of Zone from AG to AGD
because it is consistent with the amended comp plan. Ballot: Ayes -
Fenster, Hurley, Kunz, LaBart, Matthies, Nichols, Wear, Wees and
Whitfield. Nays - none. Abstain - none. Absent - Buethe. Motion carried.
2. Dale Harder, 15802 Schram Road, Gretna, requests
approval of a Preliminary/Final Plat on a subdivision to be known as Harder
Farms No. 1 on the following described property, to wit: Being a platting of
part of the SE1/4 of Sec 34, Twp 14N, Rng 11E of the 6th P.M.,
Sarpy County, Nebraska. (156th & Schram)
There were no further
comments for the Preliminary/Final Plat.
Nichols moved, seconded by
Wear to recommend approval of the Preliminary/Final Plat as it meets the
subdivision regulations. Ballot: Ayes - Fenster, Hurley, Kunz, LaBart,
Matthies, Nichols, Wear, Wees and Whitfield. Nays - none. Abstain - none.
Absent - Buethe. Motion carried.
3. Chris Lake Homeowners Association, Inc. & JaMar,
Inc., 2819 Crystal Drive, Bellevue, requests approval of a Preliminary Plat on
a subdivision to be known as Chris Lake Replat II on the following described
property, to wit: Being a replatting of part of Tax Lot C and Tax Lot H,
located in Sec 28, Twp 13N, Rng 13E of the 6th P.M., Sarpy County,
Nebraska. (30th & LaPlatte Road)
Doug Hill, Hill-Farrell
Associates, Inc., explained that the Homeowners= Association would like to use
these lots as non-residential lots for the residents to build garages. There
will be one lot available for a home. That lot sits higher than the others and
the house will be built to County guidelines with reference to flood plain
regulations, etc.
Cindy Gilbert read into record
the letter received from the Papio-Missouri River Natural Resource District (NRD).
Denny Nichols asked if
residents could later build a house on one of the outlots.
Cindy Gilbert responded by
saying that zoning ordinances will not allow a residence to be built on an
outlot.
Tom Wees questioned the
ability of the residents to be able to build mini-storage warehouses on those
lots in the future.
Cindy Gilbert stated it would
not meet the zoning regulations for a residential area.
Wees moved, seconded by
Nichols to recommend approval of the Preliminary Plat for Chris Lake
Replat II as it meets the subdivision regulations. Ballot: Ayes - Fenster,
Hurley, Kunz, Matthies, Nichols, Wear, Wees and Whitfield. Nays - none.
Abstain - LaBart. Absent - Buethe. Motion carried.
III. CORRESPONDENCE:
Tamra Madsen informed the
commissioners of the zoning actions taken by the County Board at their last
meeting. She also noted that an individual had recently filed suit against
the City of Gretna in reference to the annexation.
IV. ADJOURNMENT:
Being no further discussion, Matthies
moved, seconded by Wees, to adjourn the meeting. By a unanimous oral vote,
Chair Meyer declared the meeting adjourned at 8:03 p.m.
