To The Sarpy County Board of Commissioners:

The Sarpy County Planning Commission held its regular monthly meeting Wednesday, January 15, 2003 in the County Board Room at the Sarpy County Courthouse, Papillion, Nebraska. Chair Meyer called the meeting to order at 7:30 p.m. with the following members present: Pam Buethe, Don Fenster, Tom Hurley, Brenda Kunz, Wayne LaBart, Marcia Matthies, Don Meyer, Tom Wees, Doug Whitfield and Alan Wear. Absent was Denny Nichols. Tamra Walz, Deputy County Attorney was present. Also present were Ken Tex, Planning & Building Coordinator and Cindy Gilbert, Recording Secretary.

Chair Meyer asked for commissioner reports. There were none.

Chair Meyer called on Ken Tex to conduct the election of officers for the coming year.

Ken Tex asked for nominations for Chairman.

Pam Buethe nominated Don Meyer for Chairman.

Tom Wees nominated Alan Wear for Chairman.

Ken Tex then closed the nominations to serve as Chairman of the Planning Commission.

After a count of written ballots, Ken Tex declared Alan Wear as Chairman of the Planning Commission for the year 2003.

Ken Tex asked for nominations to serve as Vice-Chairman of the Planning Commission.

Tom Hurley nominated Tom Wees for Vice-Chairman.

Pam Buethe nominated Don Meyer for Vice-Chairman.

Ken Tex then closed the nominations to serve as the Vice-Chairman of the Planning Commission.

After a count of written ballots, Ken Tex declared Tom Wees as Vice-Chairman of the Planning Commission for the year 2003.

Tom Wees stated that he appreciated all the time Don Meyer had donated to the County and stated he thought Don was an incredible person and thanked him for his years of service as Chairman.

Chairman Wear asked for a motion to approve the agenda as submitted. Fenster moved, seconded by LaBart to approve the agenda as submitted. Ballot: Ayes - Buethe, Fenster, Hurley, Kunz, LaBart, Matthies, Meyer, Wees and Whitfield. Nays - none. Abstain - none. Absent - Nichols. Motion carried.

Chairman Wear asked for a motion to approve the minutes of the December 18, 2002 meeting. Doug Whitfield stated that he had not abstained from the vote taken on the minutes. The ballot was changed to read as follows: Ayes - Hurley, Matthies, Wear and Whitfield. Nays - none. Abstain - Kunz and LaBart. Absent - Buethe, Fenster, Nichols and Wees. Doug Whitfield also asked to add the word A Ayes@ to the third motion for Agenda Item #3. Whitfield moved, seconded by Hurley to approve the minutes as corrected. Ballot: Ayes - Hurley, Kunz, LaBart, Matthies, Meyer and Whitfield. Nays - none. Abstain - Buethe, Fenster and Wees. Absent - Nichols. Motion carried.

I. CONSENT AGENDA ITEMS:

None.

II. REGULAR AGENDA ITEMS:

1. John Milks, 11601 Mitchell Road, Springfield, requests approval of a Change of Zone from AG to AGR on the following described property, to wit: Being a platting of Tax Lots F and G, located in the NW1/4 of Sec 29, Twp 13N, Rng 12E of the 6th P.M., Sarpy County, Nebraska. (120th Street, 2 mile south of Mitchell Road)

Stu Sutherland, Basic Surveys, spoke on behalf of the Milks family stating that there is a small house that sits on this proposed lot. The Milks are looking to sell this house along with 5 acres.

Ken Tex said this lot will blend in with the area because there are already several 5, 6 & 7 acre lots in that vicinity. He also stated there is an existing driveway and won= t require any additional access.

Wees moved, seconded by Buethe to recommend approval of a Change of Zone from AG to AGR as it meets the comp plan. Ballot: Ayes - Buethe, Fenster, Hurley, Kunz, LaBart, Matthies, Meyer, Wees and Whitfield. Nays - none. Abstain - none. Absent - Nichols. Motion carried.

2. John Milks, 11601 Mitchell Road, Springfield, requests approval of a Preliminary/Final Plat for a subdivision to be known as Milk= s Second Addition on the following described property, to wit: Being a platting of part of Tax Lots F and G, located in the NW1/4 of Sec 29, Twp 13N, Rng 12E of the 6th P.M., Sarpy County, Nebraska. (120th Street, 2 mile south of Mitchell Road)

Wees moved, seconded by Buethe to recommend approval of a Preliminary/Final Plat to be known as Milks Second Addition as it meets the subdivision regulations. Ballot: Ayes - Buethe, Fenster, Hurley, Kunz, LaBart, Matthies, Meyer, Wees and Whitfield. Nays - none. Abstain - none. Absent - Nichols. Motion carried.

3. Tom Middleton, 13802 S. 132nd Street, Springfield, requests approval of a Change of Zone from AG to AGR on the following described property, to wit: Being a platting of Tax Lot 1B1A2, located in the SE1/4 of Sec 12, Twp 13N, Rng 11E of the 6th P.M., Sarpy County, Nebraska. (132nd Street & Fairview Road)

Ken Tex noted what housing currently existed in the area, particularly the subdivision, Fairview Heights, that has 1 and 2 acre lots. He also stated that access to Fairview Road already existed.

Tom Middleton stated he wished to sell this 5 acres to his son to build a home.

LaBart moved, seconded by Meyer to recommend approval of a Change of Zone from AG to AGR as it meets the comp plan. Ballot: Ayes - Buethe, Fenster, Hurley, Kunz, LaBart, Matthies, Meyer, Wees and Whitfield. Nays - none. Abstain - none. Absent - Nichols. Motion carried.

4. Tom Middleton, 13802 S. 132nd Street, Springfield, requests approval of a Preliminary/Final Plat for a subdivision to be known as Triple A T@ Acres on the following described property, to wit: Being a platting of Tax Lot 1B1A2, located in the SE1/4 of Sec 12, Twp 13N, Rng 11E of the 6th P.M., Sarpy County, Nebraska. (132nd Street & Fairview Road)

With no further discussion,

LaBart moved, seconded by Meyer to recommend approval of a Preliminary/Final Plat to be known as Triple A T@ Acres as it meets the subdivision regulations. Ballot: Ayes - Buethe, Fenster, Hurley, Kunz, LaBart, Matthies, Meyer, Wees and Whitfield. Nays - none. Abstain - none. Absent - Nichols. Motion carried.

5. Proposed amendments to the Sarpy County Zoning Ordinances and Subdivision Regulations specifically pertaining to the fees associated with applications for Special Use Permits, Zoning Changes, Platting, Board of Adjustment and Flood Plain Development Permits.

Ken Tex reviewed the fee increases with the Planning Commission noting the County Board of Commissioners had asked him to review the fees. Fees that were discussed were application fees for preliminary plats, final plats, re-zoning, administrative lot line adjustments and replats, special use permits, Board of Adjustment and flood plain permits.

Don Meyer stated that he felt the fees were good the way they are now and we didn= t need to increase them just because the other jurisdictions were higher than ours.

Don Fenster said A user fees@ were good. It keeps all taxpayers from bearing the cost of something that one individual will benefit from.

Discussion included comparable pricing with other jurisdictions, separating special uses from special use trailer permits, length of time before we change fees again, covering costs of advertising, etc.

Wees moved, seconded by Buethe to recommend approval of the fee increases as outlined, encouraging these fees to be the minimum. Ballot: Ayes - Buethe, Fenster, Hurley, Kunz, LaBart, Matthies, Meyer, Wees and Whitfield. Nays - none. Abstain - none. Absent - Nichols. Motion carried.

III. CORRESPONDENCE:

Tamra Madsen, Deputy County Attorney, said that the County Board had followed the Planning Commissions recommendations except the Special Use Trailer Permit. She stated it was a 3-2 vote to approve that application.

Ken Tex mentioned the Nebraska Planning and Zoning Association would be holding their annual conference March 26-28, 2003. He advised the Planning Commission members that it was an informative seminar and would like to see them there.

Jack Koke spoke on behalf of Sherri Eggers, noting that she is interested in subdividing land that now sits in a 20 acre minimum area. He explained that, although, there is farm land around this area, not all the land there is adequate for farming. He asked the Planning Commission to take a look at the Future Land Use Map and consider reducing the minimum acreage from 20 acre lots to 5 acre lots.

The general consensus from the Commissioners was to take a look at the Future Land Use Map in detail at the next regular meeting to be held in February.

 

IV. ADJOURNMENT:

Being no further discussion, Meyer moved, seconded by LaBart, to adjourn the meeting. By a unanimous oral vote, Chairman Wear declared the meeting adjourned at 8:52 p.m.
